TERMS AND CONDITIONS FOR THE PROVISION OF PROPERTY SEARCHES AND REPORTS, SAP, PEA, RESIDENTIAL AND COMMERCIAL EPC. QUOTES FOR CONVEYANCE AND MORTGAGES
For the purposes of these terms and conditions any reference to Pali means Pali Ltd, any Pali Franchise and any third party organisations, agencies, associates or employees used during the course of legitimate business. Pali Ltd reserves the right to employ any suitably qualified subcontractors or agencies in the performance of its duties.
Customer means the person, company, partnership or other organisation placing an order either on their own behalf as a Client or as agent for a client.
We us and our are references to Pali. Instructions, requests or orders must be made in a recordable manner such as email, fax, post, DX or the Pali System.
Telephone instructions will not be accepted.
All quotations will be on the basis of information supplied by the client and that gathered by Pali or their agents. Reports produced from incorrect information provided by the client will still be charged for.
Pali reserve the right to vary the price quoted in the event of the information provided by the client being incorrect.
Reports and certificates remain the property of Pali until final payment has been made.
Each report or certificate is deemed to be an individual contract governed by English Law.
Pali will produce the reports and certificates with reasonable care and skill and they are provided to the client on the basis that they acknowledge and agree to the following:
The information in the report reflects that available to us on the date the report was produced.
The information contained in a report can change and we cannot be responsible for any changes after the date on which the report was produced.
The position of any property or apparatus shown on any maps or diagrams attached to the report are approximate and are furnished as a general guide only. No warranty as to their correctness is given or implied.
The report does not give details of the actual state or condition of the property or the apparatus mentioned in the report nor should it be used or taken to indicate or exclude actual suitability or unsuitability for any particular purpose or relied upon for determining saleability or value. Further information and advice should always be obtained from appropriate experts and professionals.
Pali have insurance in place to protect the client against negligence by us and with regard to information included in the report.
PAYMENT TERMS.
FOR SOLICITORS credit terms can be negotiated for conveyancing reports provided on an ongoing basis.
For personal searches this is normally thirty days from end of month. For council provided searches this is the Friday of the week of order.
FOR DEVELOPERS, BUILDERS AND OTHERS IN THE BUILDING INDUSTRY.
On quotations of £1000.00 and under payment in full is required prior to commencement of work.
On quotations of over £1000.00 and up to £2000.00 payment of 50% is required prior to commencement and the balance on completion of work and before delivery of reports.
On quotations over £2000.00 payment of 20% on acceptance and awarding the work to Pali Ltd. A further 30% on starting work and the balance on completion.
Failure to pay will incur a charge of 8% above the Bank of England base rate from time to time commencing from the date of invoice. If legal action to recover monies is started an additional amount for compensation and all legal costs will be added to the bill.
In all cases certificates and reports will be presented on final payment.
If the work is cancelled after acceptance Pali will be entitled to all expenses incurred for wages, travel and materials unavoidably charged up to the point that the client notifies Pali.
Notification of cancellation must be in a recordable manner as above.
